By the Law on the Right of Access to
Information, issued in the
24 October 2003
dated Official Gazete with No.25269,
and the By-law on Rules and Procedures for
the Implementation of the Law on Right of
Access to Information, issued
in the
27 April 2004
dated Official Gazette with No.25445;
the procedures concerning the way of
application to be made within the frame of
this law and the relevant methods have been
set out in detail. According to that bylaw;

Method of Application; |
|
Application for knowledge acquisition to be
made by real and legal persons. A petition
containing the name and residential address
of the applicant, if he/she is a real
person, or the title, address and
authorization certificate of the applicant
if it is a legal person are required to be
submitted to the knowledge acquisition unit
of the institutions and organizations, where
the demanded information or document exist. |

Applications to be Made Electronically; |
|
For the applications to be made via
electronic mail, the related petition forms
being issued on the web page of the
institution are filled up and name, surname,
residential address and T.R.ID.No of the
applicant are indicated in the forms.

Nature of the Information and Documents to
be Demanded |
|
Application for knowledge acquisition should
be related to the documents that are
required to be in the institutions and
organizations, to which the application is
intended to be made. However, it is
essential to determine whether the
information or documents requested by a
petition are available in the records of the
institution and organization, and to ensure
that the process of provision of the
information and documents shall not
interrupt the routine works of the
institution or organization and shall not
bear an unreasonable workload to the
institution. |

Information and Documents Issued or Declared
to the Public: |
|
Information and documents published by the
institutions and organizations, or the ones
declared to the public by publication,
brochure, announcement and other similar
means cannot be included in applications for
knowledge acquisition. |
|
Prohibition of Issuance of the Information
and Documents: |
|
According to the bylaw, the press organs may
not reproduce or use for commercial purposes
the information and documents reached within
the frame of the methods and principles
stated in the law and bylaw. They may not
publish the information and document unless
receiving permission form the issuing
institution and organization. |
|
Approval, Evaluation and Implementation of
the Applications: |
|
For approval of the application petitions,
it is essential to make an application in
accordance with the law. For filling up the
petition form completely, help can be asked
from the officials in the institutions and
organization, who are responsible for
knowledge acquisition. For the applications
to be made electronically, the petition is
put into process after verification of the
T.R. ID. Number. |

Help to the Applicants: |
|
The officers serving in knowledge
acquisition units are required to help and
guide the applicant for enabling him/her to
utilize his/her rights. |
